Whether or not the likes of Tom Udall in Congress' new majority had anything to do with it, President Bush's long claim to a divine right to spy on his fellow Americans at last is showing signs of erosion.

For years, Udall was one of too few voices against such outrages as the USA Patriot Act and other incursions on privacy rights. Republicans led the charge against the Constitution -- but many of the Northern New Mexico representative's fellow Democrats followed.
